Partner visas enable you to be sponsored for a visa if you are legally married, in a defacto relationship or engaged to be married to an Australian citizen or Permanent Resident or Eligible New Zealand Citizen.

There are two steps to the Partner visa application process.

  • In the first stage a temporary Partner visa is granted, with full work and travel rights and accessto Medicare.
  • The second stage occurs two years after the grant of the temporary visa when a Permanent Partner visa is granted.
  • For partner visa applicants who are engaged to be married, a third visa stage occurs prior to arrival in Australia, giving time for the applicant to travel to Australia and marry their spouse.

Onshore Visa Types: Partner Visa Subclass 820/801

  • For those couples who already live together in Australia.
  • If you're married or in a de facto relationship with an Australian Citizen or Permanent Resident, the Subclass 820/801 visa is your pathway to your residency and shared life in Australia. It's essential that you're both inside Australia at the time of application and when the visa is granted.
  • This two-stage process starts with the temporary visa (Subclass 820), leading to permanent residency (Subclass 801).

Offshore Visa Types: Partner Visa Subclass 309/100

  • For couples currently living apart, outside of Australia.
  • If you're outside Australia but married or in a de facto relationship with an Australian Citizen or Permanent Resident, the Subclass 309/100 visa bridges that distance. This visa requires you, as a spouse, to be outside Australia when you apply and when it's granted.
  • Like its onshore counterpart, this process begins with a temporary visa (Subclass 309) and transitions to a permanent residency visa (Subclass 100) in the second processing stage.

Prospective Marriage Visa Subclass 300 (Fiancé Visa)

  • For engaged couples planning to marry.
  • Engaged to an Australian Citizen or Permanent Resident? The Prospective Marriage Visa Subclass 300 is your first step towards a wedding and life in Australia. This visa allows you to enter Australia to marry your fiancĂ© within 9 months of arrival.
  • Following your marriage, you can transition to an onshore Partner Visa (Subclass 820/801) to begin your married life in Australia.

If you are engaged to an Australian citizen, permanent resident, or eligible New Zealand citizen, you can apply for the Subclass 300 Prospective Marriage Visa, also known as the Fiancé Visa, to join your fiancé in Australia.


This visa permits a stay of up to 9 months, allowing you to marry and subsequently apply for both the Subclass 801 and 820 Subclass Visas.

How long does a partner visa take to process?

Estimated processing timeframes for Partner Visa applications can change depending on a number of factors including the date you submitted your application, government visa priorities, and the number of applications that are being lodged.

To ensure your Partner Visa application is processed smoothly in the fastest time possible aim to submit a Decision Ready application with police checks, health examinations and sponsor application completed as soon as possible after lodging.

How much does it cost to lodge a partner visa?

Costs associated with lodging a Partner Visa application include: Home Affairs application fee, Home Affairs card payment surcharge, police clearance fees, health examination fees, translation fees and Migration Agent fees.

As of January 2024, the Home Affairs’ Partner Visa and Prospective Marriage Visa application fees are currently AUD$8.850. These fees are set by the Australian Department of Home Affairs:

What happens if my Partner Visa gets rejected?

If your partner visa is refused you may be able to appeal the refusal decision through the Administrative Appeals Tribunal. it is extremely important to read the refusal notification from Home Affairs carefully. There are strict timeframes to appeal a refusal decision which must be adhered to.

Will I be granted a permanent residency with a partner visa?

Yes, obtaining a permanent residency through a partner visa is possible. Initially, you might apply for a temporary partner visa (such as the Subclass 820 for onshore applications or Subclass 309 for offshore). After meeting certain conditions, including a relationship period typically around two years from your initial application, you can then be eligible to apply for or transition to a permanent partner visa (Subclass 801 or Subclass 100). Successful approval of the permanent partner visa grants you permanent residency in Australia, allowing you to live, work, and study in Australia indefinitely, along with other benefits such as access to social security benefits and eligibility for Australian citizenship, subject to meeting all necessary criteria.

How long do I have to be in a defacto relationship for before I can lodge my Visa Application?

For most partner visa applications, including both de facto and married couples, you need to have been in the relationship for at least 12 months prior to lodging your application. However, there are exceptions to this rule, such as having registered your relationship with an Australian state or territory, which might allow you to apply earlier. Each case is unique, so it's essential to consult with a migration expert to understand how the specific circumstances of your relationship might affect your eligibility and the timing of your visa application.
