The Three Main Partner Visa Types
Before we get to the scenarios, here’s a quick refresher on the Partner Visa options:
???? Onshore Partner Visa (Subclass 820/801)
For couples applying when the applicant is in Australia. If you meet the requirements, you apply while you’re here and can stay while it’s being processed.
???? Offshore Partner Visa (Subclass 309/100)
For couples applying when the applicant is outside Australia. The applicant must be offshore when applying but can be in or outside of Australia when the visa is granted.
???? Prospective Marriage Visa (Subclass 300)
For engaged couples who plan to marry in Australia. The visa allows the applicant to travel to Australia to get married within a set timeframe. Once married, the applicant can apply for an onshore Partner Visa.
Each of these visa types follows a two-step Partner Visa process: temporary visa first, then permanent residency.
These three visa types cover a wide range of real-life relationship situations.

Partner Visa Pathways
1. Visitor Visa → Partner Visa
If your partner is in Australia on a visitor visa and your relationship becomes serious during their stay, it’s possible to transition to an onshore Partner Visa—if you meet the eligibility criteria and there are no “no further stay” conditions.
The Visitor Visa to Partner Visa Pathway is one of the most popular pathways we see for couples, but timing and strategy are everything.
2. Student Visa → Partner Visa
Studying in Australia and falling in love? It’s more common than you think.
We work with many couples who start their relationship while they are studying and decide to stay together once the student visa is close to expiring. Compliance, evidence, and timing are critical when you are moving from a Student Visa to a Partner Visa.
3. Work Visa → Partner Visa
If you’re in Australia on a temporary work visa and are a genuine relationship with an Australian citizen or permanent resident, you may be able to transition to permanent residency via a Partner Visa.

4. Working Holiday Visa → Partner Visa

5. Living Overseas Together → Offshore Partner Visa
We help many couples who have built their life together outside Australia and now want to move. If you’ve been living together overseas and your spouse or de facto partner is Australian, the offshore Partner Visa (Subclass 309/100) may be the best fit.
This option is also useful for couples in marriage or de facto relationships who have had to spend time living apart in different countries.
6. Engaged? → Prospective Marriage Visa
If you’re engaged but not yet living together or don’t meet the de facto requirements, the Subclass 300 Visa allows you to come to Australia, marry your partner, and then apply for a Partner Visa onshore.
